FERC Grants Declaratory Order to WPPI Energy Approving Favorable Rate Treatments for La Crosse Electric Transmission Project

October 3, 2012

On October 1, 2012, FERC granted in full WPPI Energy’s petition for a declaratory order, WPPI Energy, 141 FERC ¶ 61,004 (2012). It concerns the “La Crosse Project,” which is a high-voltage transmission line from south of Minnesota’s Twin Cities to the other side of the Minnesota-Wisconsin border.  As requested, FERC awarded a hypothetical capital structure of 45%, applied to the same equity return level as other Midwestern transmission owners, along with some assurance of recovery if the project is abandoned, and the creation of a “regulatory asset” to hold costs for later recovery.

Spiegel attorneys David Pomper, Cindy Bogorad, and William Huang worked on the petition.  Read the order below.
