On October 1, 2012, FERC granted in full WPPI Energy’s petition for a declaratory order, WPPI Energy, 141 FERC ¶ 61,004 (2012). It concerns the “La Crosse Project,” which is a high-voltage transmission line from south of Minnesota’s Twin Cities to the other side of the Minnesota-Wisconsin border. As requested, FERC awarded a hypothetical capital structure of 45%, applied to the same equity return level as other Midwestern transmission owners, along with some assurance of recovery if the project is abandoned, and the creation of a “regulatory asset” to hold costs for later recovery.
