Spiegel & McDiarmid LLP Helps Maryland County Defend Transit-Oriented Development Plan, Defeating Disruptive LNG Storage Facility

Since 2009, firm partners David Pomper, Peter Hopkins and Scott Strauss have been representing Prince George’s County, Maryland, in multi-forum litigation concerning Washington Gas Light Company’s plan to build a Liquified Natural Gas storage facility in a stream valley near the West Hyattsville Metro Station, in the County’s unincorporated “Chilllum” neighborhood.  Although the County’s transit-oriented development plan calls for a “Greenway” on the site at issue, WGL brought federal court litigation raising preemption claims under the Natural Gas Act, Pipeline Safety Act, and state law.  In a thorough Memorandum Opinion issued March 9, 2012, the Honorable Deborah K. Chasanow, Chief Judge of the U.S. District Court for the District of Maryland, has granted summary judgment for the County on all points.
