On September 29, Tim Lay will conduct a teleconference seminar presented by the National Business Institute (NBI) entitled “Cell Tower Zoning and Placement: Navigating Recent FCC Changes.” The program will cover how Section 6409(a) of the 2012 Middle Class Tax Relief and Job Creation Act coincides impacts land use and zoning applications to modify existing wireless facilities and what local governments can and cannot do when denying a wireless application under Section 332(c)(7) of the Communications Act. The program also will provide an update on the Supreme Court’s recent decision construing Section 332(c)(7) and help participants gain a better understanding of the FCC’s environmental and historic preservation review process for wireless facilities and how local governments can participate in that process.
