Cell Tower Zoning and Placement: Navigating Recent FCC Changes

This paper by Tim Lay, Jessica Bell and Frances Wade comes out of a program on how Section 6409(a) of the 2012 Middle Class Tax Relief and Job Creation Act impacts land use and zoning applications to modify existing wireless facilities and what local governments can and cannot do when denying a wireless application under Section 332(c)(7) of the Communications Act.  Sponsored by the sponsored by National Business Institute, the program also provided an update on the Supreme Court’s recent decision construing Section 332(c)(7) and help participants gain a better understanding of the FCC’s environmental and historic preservation review process for wireless facilities and how local governments can participate in that process.
