Representative Matters

  • Represented a non-profit generation and transmission cooperative as an intervenor supporting the Federal Energy Regulatory Commission in a challenge to PJM Interconnection, L.L.C.’s “focused” minimum offer price rule (MOPR). The court affirmed FERC. PJM Power Providers Grp. v. FERC, 88 F.4th 250 (3d Cir. 2023).
  • Represented the City and County of San Francisco in FERC hearing proceedings regarding nondiscriminatory access to wholesale distribution service, which has included responding to discovery requests, working with experts to develop testimony, preparing witnesses for hearing, cross examining witnesses at hearing, and briefing.
  • Represented the City of West Des Moines in defending against a petition for a Federal Communication Commission declaratory ruling filed by an incumbent cable operator pursuant to section 253 of the Communications Act of 1934. Following the City’s answer, the parties reached a settlement and the petition was withdrawn.
  • Assisted clients in successfully obtaining from FERC terminations of certain Public Utility Regulatory Policies Act of 1978 (PURPA) obligations.
