David Pomper appeared on a panel at the Energy Bar Association’s 2018 Annual Meeting and Conference. The panel, “State of Flux – Analyzing Recent Transmission ROE Decisions and the Impacts on Transmission Return on Equity,” also featured former Federal Energy Regulatory Commission (“FERC”) Commissioner Suedeen G. Kelly, now at Jenner & Block; Robert S. Kenney, Vice President, Pacific Gas & Electric; and Nina Plaushin, Vice President, ITC Holdings Corporation. The panelists discussed two recent appellate decisions on the return on equity for electric transmission companies (California Public Utilities Commission v. FERC, 879 F.3d 966 (9th Cir. 2018), and Emera Maine v. FERC, 854 F.3d 9 (D.C. Cir. 2017)), and related ongoing litigation at FERC. You may read David’s presentation slides at the link below.
