This is another memo in our series of updates on environmental regulations affecting the utility industry. EPA has proposed amendments to its National Air Emission Standard for Hazardous Air Pollutants (NESHAP) for stationary reciprocating internal combustion engines (RICE) relaxing the circumstances under which a RICE engine may be operated and still be considered an “emergency” unit. Though these amendments are largely favorable to the public power sector, for some they may not extend far enough. Comments on the proposed amendments are due on August 9, 2012.
