Tim Lay Gives Webinar on Zoning and Wireless Facilities

On September 29, Tim Lay conducted a teleconference seminar presented by the National Business Institute (NBI) entitled “Cell Tower Zoning and Placement: Navigating Recent FCC Changes.”  The program covered how Section 6409(a) of the 2012 Middle Class Tax Relief and Job Creation Act impacts land use and zoning applications to modify existing wireless facilities and what local governments can and cannot do when denying a wireless application under Section 332(c)(7) of the Communications Act.  The program also provided an update on the Supreme Court’s recent decision construing Section 332(c)(7) and help participants gain a better understanding of the FCC’s environmental and historic preservation review process for wireless facilities and how local governments can participate in that process.  A paper on the topic, co-authored with Jessica Bell and Frances Wade, is linked below.
